Court and Tribunal Experience
My work as a barrister has included appearances before the Social Security Appeals Authority; the Complaints Review Tribunal (now known as the Human Rights Review Tribunal); the Planning Tribunal (now known as the Environment Court); the District Court, the High Court, and the Court of Appeal. I have also been involved in the presentation of evidence and submissions before Commissions and Committees of Inquiry. I have been involved in conciliation processes (eg, where a privacy complaint is being investigated by the Privacy Commissioner), or where mediation has been used as a dispute resolution process. I have also appeared before council committees (eg, on issues arising under the Resource Management Act 1991).
Important decisions with human rights implications in which I have been involved include –
- House v A-G (SC-1977) – first decision of the NZ courts to recognise that exemplary damages might still be available where an injury had occurred, despite the enactment of the Accident Compensation Act 1972
- Bos v Police (HC-1981) 1981 Springbok rugby tour – disorderly behaviour
- Cuthbert v Police (HC-1992) Obstruction of the police during demonstration at international tennis tournament – relevance of the NZ Bill of Rights Act 1990
- Bramwell v Director-General of Social Welfare [2001] NZAR 680 (CA) – Rights of beneficiaries
- CanWest TVWorks v XY [2008] NZAR 1 (HC) – Broadcasting Act 1989 – scope of BSA’s privacy principles
